Upon Further Review: Magouirk Case Turns Weird

According to several different bloggers, Judge Boyd in the case classifies himself as pro-life. Here is one of the stories from a blogger who spoke with the Judge via Email and over the phone. Basically, it appears that while Ms. Magouirk was not on the feeding tube, she needed to be and needed care that the hospice was not providing. Also, it appears that this judge in the case, upon further examination, demanded that while the evaluation by cardiologists were taking place, that Ms. Magouirk would be fed. So, it appears that we have a case of a granddaughter who took the easy advice of doctors for the convenience of seeing grandmama go to Jesus so she wouldn't have to take care of her anymore, and a judge who FOR ONCE wanted to see a comprehensive examination done, and who instituted the immediate evaluation and feeding requirements to keep Ms. Magouirk alive and able to be examined. I take back my detrimental comments about this judge in light of what I have now read. I only wish Terri Schiavo would have had the due process that it appears that Ms. Magouirk has been afforded, and I say that the granddaughter should be villified for her flippant attitude and remarks. If she doesn't want to care for Granny anymore, she should send her to folks who care.....

THOSE are the words of Judge Donald Boyd whose Georgia court was at the centre of the fight over the life of 80 year old Mae Magouirk.

I spoke by phone to Judge Boyd today at his home in La Grange, Georgia, and he was anxious to make his pro-life views known particularly after the death of Terri Schiavo which he says he found very disturbing.

"I was alarmed myself by what Judge Greer did in the Schiavo case, he said.

Judge Boyd said that the decision concerning Mae Magouirk was made by her family after a meeting between attorneys acting for her granddaughter, Beth Gaddy, and her brother and sister, Mr A McLeod and Mrs Lonnie Mullinex.

"My role was simpy that I appointed Ms Gaddy as an emergency guardian over the weekend of April 2-3 until the court could conduct a full hearing on Monday April 4," he said.

"There was a 90 minute hearing on the morning of April 4 and an adjournment for the parties to enter into discussion.

"Subsequently, there was an agreement made between the parties that three doctors evaluate Miss Magouirk's condition (she has an aortic dissection) and that all parties would agree to the recommendations of the majority.

"In my orders I stipulated that the doctors evaluate Miss Maguoirk within 24 hours or as soon as possible because time was of the essence."

Judge Boyd said that Miss Magouirk had never been connected to a feeding tube and there was no question that hydration and nutrition had been withdrawn.
"Her living will did not come into play because of the agreement between family members. It would have been a major consideration had the case proceeded."

Judge Boyd said that Miss McGouirk's admission to the hospice had been on the recommendation of doctors to Ms Gaddy.

"When I returned to the court following the agreement the family members appeared to have been reconciled and were hugging each other," he said.



However, things are not so clear....Another blogger talked to the judge and got three or four different answers. It appears there is a lot of CYA to go around here. At least the good news is that Mae is getting the best medical attention she can and is not in a place waiting for her to die....From Straight Up with Sherri, a Georgian blogger:
The judge told the caller on Joseph Farah's show that the family agreed to the guardianship and that Mrs. Mae never had a feeding tube. Joseph says that the family says that is totally false.

I got on and expounded on my position that the state survey agency should investigate this.

I talked with that Judge.

He told me it was all out of his hands- and up to the doctors per the hearing on MONDAY!

Did YOu all READ the latest Email sent by Kenneth?

I spent ALL day calling people.

Including the attorney for Kenneth- etc. The Judge was the only one I got to talk to in person- other than the lady at hospice. (She doesn't like me) I asked her a hard question and she accused me of being rude.

LOL!

Okay-

I asked her- "Is it policy at your Hospice to consider the next of kin to be a grandaughter over a brother or sister?"

She said "Go look at the court records."

I said, "Let's forget this specific case. I am asking you about your policy."

She said, "You are being rude and yelling at me."

I said, "No, I am asking you about your policy." (keep in mind-- NO ONE IS YELLING! NOT HER- OR I!)

Again, she said "Go look at the court records."

THIS IS NOT SOMEONE TRYING TO GET THE TRUTH OUT! THEY ARE HIDING SOMETHING!

The In-House Attorney- that noticed the mistake that the Hospice made is suddenly "gone for the week."

Mae was put into ICU- then the grandaughter denied her a feeding tube and hydration and THEN had her moved to a Hospice to die.

Get it?

Mae didn't need a feeding tube until she had compications with the surgery and was put in ICU.

Many people need a feeding tube TEMPORARILY!

Especially when they are all drugged up and unable to eat!

THIS is how I understand the facts to be.

Good information. You guys can go ahead and email Hannity, and any other media outlets you want. I did, working off an old list Sherri posted. That list is updated here: http://powersthatblog.blogspot.com/2005/03/email-media-outlets.html . There are media outlets, but also senators and other politicians. Hopefully the story will at least get some press. People need to know that this sort of thing is happening to more people than just Terri. And this woman, Mae, isn't even brain damaged. Can we say slippery slope?

have NO CLUE!

I talked with the judge-- he tried to tell me it was all over too-- but then I talked with Kenneth...

The judge also told me that the doctors had a conference call meeting Monday night and didn't know what they decided. THIS is now FRIDAY! We still don't know??

I mean-- Kenneth's email says it all-- I think...

Kenneth gives us the info to check fo ourselves-- the case # and everything..

The judge- I had to ask him 3 different times what was decided.. and the wording changed ALL 3 TIMES!

I do know that the JUdge was TICKED and left a nasty message to someone-- can't say who--

"off the record"

So, even though there are some discrepancies in the case, more to be vetted, the GREAT NEWS is that Mae is no longer 'waiting to go home to Jesus' but is getting the best care possible, I am sure much to the dismay of Ms. Gaddy, who stood to inherit 500 grand. Stay tuned....
