Darn that Alito Cabal--Recruiters Back at Law Schools


But, alas, he did not rule on this case...so sorry, conspiracy buffs!

A college can be stripped of federal funding if its law school denies full access to military recruiters because it opposes the "don't ask, don't tell'' policy on gays and lesbians in the armed forces, the U.S. Supreme Court ruled unanimously Monday.

The court rejected law schools' arguments that requiring them to treat the Pentagon like any other employer violated their freedom of speech by forcing them to spread a message they oppose.

"Accommodating the military's message does not affect the law schools' speech, because the schools are not speaking when they host interviews and recruiting receptions,'' Chief Justice John Roberts wrote in the 8-0 decision. Justice Samuel Alito, who was not on the court when the case was argued in December, did not participate.

"Law schools remain free under the statute to express whatever views they may have on the military's congressionally mandated employment policy, all the while remaining eligible for federal funds,'' Roberts said.


Yes, what if I ran a law school and thought that the ACLU's blatant twisting of the Constitution was wrong. Should I be allowed to throw them off campus, liberals? What if I thought abortions were wrong, should I be allowed to throw NARAL off campus ? What about gay marriage? Should I then be able to throw off the Gay/Lesbian Union groups?

See, this is the paradox liberals want. They want to be able to throw off the military recruiters citing free speech. However, if a conservative college threw off any of the groups I have mentioned, these schools would be filing briefs saying the college discriminated against a legitimate employer, and that I as the head of the college should not decide for my students who interviews them for jobs.

It is so nice to see logic on the court. I am so surprised Ruth "Buzzy" Ginsberg sided with the military on this one. This case did not involve lowering the age of consent or making prostitution legal. Maybe old age has given her liberal dementia, what most of us would call a case of common sense.
