"Under God"

The Supreme Court preserved the phrase "one nation, under God," in the Pledge of Allegiance, ruling Monday that a California atheist could not challenge the patriotic oath but sidestepping the broader question of separation of church and state.

At least for now, the decision - which came on Flag Day - leaves untouched the practice in which millions of schoolchildren around the country begin the day by reciting the pledge.

The court said atheist Michael Newdow could not sue to ban the pledge from his daughter's school and others because he did not have legal authority to speak for her.

Newdow is in a protracted custody fight with the girl's mother. He does not have sufficient custody of the child to qualify as her legal representative, the court said. Eight justices voted to reverse a lower court ruling in Newdow's favor.

Excellent news on Flag Day! While I would have prefered a really good "smackdown" from SCOTUS, I'll gladly take what I can get...

Mark's Remarks


As usual, this Court is more than willing to allow Mexican trucks that are unregulated to cross into the United States, but God forbid they actually TAKE A STAND on a fundamental issue. Instead, they find a loophole to get out of it. Why not just lay the smackdown on this issue once and for all and confirm the Pledge, rather than use mumbojumbo and smoke and mirrors. While this is a victory, it is not a complete one.

And I am so happy that Newdow was smacked down. This guy is a total whackjob. Through his efforts (even over his daughter's objections), he has brought undue attention that could be harmful onto his children, and I hope the court deciding his custody case takes his fanaticism into account before rendering a decision.
