Pepper and More Liberal Projection

The Ohio Republican Party spoke out against David Pepper:
The Ohio Republican Party today demanded that Democratic State Auditor candidate David Pepper cease and desist airing an attack ad on his Republican opponent because it contains false statements.

"David Pepper is lying, and he intentionally aired these false statements four days from the election so he could avoid being taken to the Ohio Elections Commission," said Ohio Republican Party Chairman Kevin DeWine. "Pepper's outright fabrications prove he's unfit for the office he seeks, an office that requires truth and accuracy above all else. Ohioans have had enough of politicians with Pepper's kind of elastic integrity."

The ad implies Yost is responsible for "big spending" and "higher taxes," yet Yost has kept his county budgets lower than any other county of comparable population in Ohio. He also has never raised a tax while serving in public office as a county auditor and prosecutor, offices that have no control over taxes.

"It's actually David Pepper who has a very clear record of raising millions of dollars in taxes and spending," said DeWine. "It's unfortunate that just 48 hours after decrying negative ads, he became desperate enough to launch one of the most deceptive attacks of the season. It's even more pathetic that he didn't have the guts to do it when he could be held accountable for his lies."

Hey Pepper, let's speak some truth to power and then go run tell dat! To Wit:
When the voters rebelled and forced the tax hike to a vote, he campaigned hard to keep it. The voters repealed his tax anyway. Only then did he cut the budget -- because he was forced to do so. Now he wants to claim for himself a cloak of virtue for doing what the voters forced him to do against his will. David Pepper spent $4,000 to buy himself new office furniture because he wanted something “more stylish.” Seriously.

Under Pepper’s watch, Hamilton County has continued to waste money on a train station that has already cost taxpayers over $47 million -- even though Cincinnati has no rail transportation. According to the Cincinnati Enquirer, the train station is virtually abandoned: “Six years after being hailed as a vital hub for the region's bus and future passenger rail service, the Transit Center is almost always empty -- all 3,740 feet, 23,800 tons of concrete and 20 bus bays of it.”

But that didn’t stop Pepper from bragging about a $5 million project to renovate the seldom-used transit center. Pepper touted the so-called “stimulus” project, stating: “The result of these investments will be job creation and economic stimulus in the short run, and the transformation of our Riverfront in the long run.”

While the county was facing a serious budget crisis, Pepper and the County Commission hired “environmental czars,” or a taxpayer-funded, county-level Environmental Protection Agency. It’s a mystery why a county with serious budget problems needed this, since it is not required by state law, and the EPA already operates at the state and federal level.

Pepper voted to pay a private law firm $17 million taxpayer dollars to help with a private development in Cincinnati. The Hamilton County Prosecuting Attorney, who legally represents the Board of Commissioners said that Pepper’s contract “…allowed the outside law firm ‘to run wild’ racking up millions of dollars in fees unchecked and unsupervised”

When Hamilton County judges voided the contract, Pepper voted to take the issue to the Ohio Supreme Court. He lost. When Pepper became a City Councilman, City spending was at $937 million. By the time he left, the budget had ballooned to $1,111,500,000 – an 18.5% increase. It seems David Pepper only thinks spending is bad when someone else does it.
Pepper has spent public money on a train station that has no trains and created a duplicative county-level EPA – even though we have a state and federal one. He allowed tax money to go to a department store renovation that paid for mannequins.

Really, David, this obsession with mannequins....Sad......

What? Governor Strickland Uses Office for Payoffs to Unions?

Color me shocked. A suit by the 1851 Center alleges the following:
n IOctober, the 1851 Center filed an action under the Ohio Corrupt Activities Act (Ohio RICO) to stop costly union-friendly public school building projects that result from a pattern of bribery and intimidation originating from Ohio School Facilities Commission Director Richard Murray, Governor Strickland, and powerful labor union interests, and filter down to the local level.

The complaint charges labor unions and Murray used bribery, intimidation, and obstruction of justice to further union financial interests, through projects funded by the OSFC, while the Strickland administration aided and abetted the conduct for its own political gain. The lawsuit seeks to prohibit future distribution of state tax dollars by the OSFC to fund union-friendly "Project Labor Agreements" (PLAs) and prevailing wage-only projects.

The complaint also details how Murray orchestrated secret meetings between labor union leaders and school superintendents. At the meetings, unions offered political support in facilitating passage of local school district tax levies for building school buildings in exchange for the superintendents' promises to use expensive union-only labor when later building those schools.

"It certainly appears as though union influence over the Strickland administration caused the firing of the prior OSFC director, and the hiring of Murray, with either the instructions or the implicit understanding that Murray would run rough-shod over taxpayers and school districts to benefit union allies," said 1851 Center Executive Director Maurice Thompson. "School districts are making construction decisions within this troublesome framework. This suit aims to clean up the process before additional tax dollars are wasted."

This fall, organized labor union interests in the construction industry have contributed $582,000 to Strickland's re-election and $463,000 to the Ohio Democratic Party.

Construction union contributions to help pass local school building levies are public records, and are available at your county board of elections.

Read the complaint here.

To quote a frenchie: "I am shocked...shocked..to find gambling going on in this establishment!"

Strickland and his administration have long been about payoffs for votes, from teacher unions to construction unions to allowing criminals to work in the mansion and peddle drugs under the governor's nose.

Those FAKE Ohio Tea Party Mailers

Imagine my surprise when I opened the mailbox yesterday to discover a mailer from an organization calling itself The Ohio Tea Party that endorsed DEMOCRAT Arnie Engel for the 54th District Ohion House race.
SIDEBAR: Arnie likes to play his little games himself.  He is running as a fiscally conservative (which he is) "Independent".  Have you ever heard of an independent who is the regional chairman for the local county Democrat party?  I haven't either...)Turns out the Ohio Liberty Council has NO IDEA what these mailers are about and didn't send them
So, who or what is The Ohio Tea Party, you might ask?  Their treasurer is listed as Jacob Jeffers and the "organization" is using Jeffers' Bedford, OH address on its mailers and in its filing with the Ohio Secretary of State's office.  Oh, that filing...so glad you asked...is dated 10/21/10.  That's right: LAST WEEK.

I've done a little background research on Mr. Jeffers, and I don't like what I see so far...but we'll get to that later.

I just wanted to make sure that everybody knows that if you see a mailer that appears to be coming from the Ohio Tea Party, it probably isn't.

    I smell a a RAT...a DEMOCRAT RAT...but I repeat myself.

It is entirely possible that Mr. Engel was not given any prior knowledge about these mailers and if I am to understand his position on endorsements correctly, he isn't interested in them anyway.  Engel out to publicly condemn these mailers as misleading.  Mr. Engel, I can be reached at wmdtvmatt-at-yahoo-dot-com.

OHD-89: Ironton Tribune endorses Dr. Terry Johnson

    Release:
The Ironton Tribune has endorsed Dr. Terry Johnson to be the next State Representative for Ohio’s 89th House District, citing his proven record of leadership and his courage to tackle seemingly insurmountable problems.

“Dr. Terry Johnson has demonstrated (leadership) while serving the United States of America in the National Guard during wartime,” the Tribune said.

“Those unique experiences and his medical background set him apart from his opponent and would allow him to bring a much-needed perspective to the Ohio House of Representatives. For that Dr. Johnson is the best candidate to represent Southern Ohio in the 89th District that includes western Lawrence County.”

The Tribune also praised Dr. Johnson’s work fighting prescription drug abuse as Scioto County Coroner, saying it shows he has the courage and tenacity to tackle what some might call an insurmountable problem.

If elected, Dr. Johnson will be the only physician in the Statehouse. The Tribune said that Columbus would benefit from his medical expertise as they tackle issues such as health reform.

“It may be a rare occurrence in today’s culture, but hopefully Terry Johnson will be given the opportunity to make a ‘House’ call,” the Tribune concluded.
That endorsement may be found here.

    On Free Trade

I keep seeing these ridiculous commercials where Democrat incumbent governor keeps slamming Republican challenger for having the gall to support free trade and I keep remembering this little exchange from one of my favorite episodes of the West Wing: ("Somebody's Going to Emergency, Somebody's Going to Jail")
Toby: You want the benefits of free trade? Food is cheaper.

    Policewoman: Yes.

Toby: Food is cheaper! Clothes are cheaper, steel is cheaper, cars are cheaper ... Phone service is cheaper! You feel me building a rhythm here? That's because I'm a speech writer and I know how to make a point.

    Policewoman: Toby.

Toby: It lowers prices, and it raises income. You see what I did with 'lowers' and 'raises' there? It's called the science of listener attention. We did repetition, we did floating opposites, and now you end with the one that's not like the others. Ready? Free trade stops wars. And that's it. Free trade stops wars, and we figure out how to fix the rest. One world, one peace... I'm sure I've seen that on a sign somewhere.
So, keep on trashing free trade Democrat incumbent, nobody is paying attention anyway...right?

OEC Exposes Democrats’ Defamation Of State Reps Sears and Snitchler

    Release:
COLUMBUS—The Ohio Elections Commission today ruled that the smear campaigns launched by the House Democratic Caucus Fund against Reps. Barbara Sears (R-Monclova Twp) and Todd Snitchler (R-Uniontown) are false. The ruling discredited the Democrats’ claims that, in opposing House Bill 19, Sears and Snitchler voted to allow child molesters and sex offenders to work as school bus drivers. The House Democratic Caucus Fund agreed to a stipulation that they violated the false statement statute in lying about the voting records of Rep. Sears and Rep. Snitchler.

“The Democrats have shown that they know no bounds when it comes to their dirty gutter politics,” said Ohio House Republican Organizational Committee director Mike Dittoe. “All they’ve done is waste time by distracting from the facts.”
Sears filed the elections complaint on the grounds that the House Democratic Caucus lied in two television ads. Contrary to these ads, prior to HB 19, criminals who were convicted of molesting and abusing children were already prevented from being school bus drivers. House Bill 19 actually weakened the restrictions on convicted criminals who could pose a threat to Ohio’s schoolchildren.

“I’m pleased that the OEC cleared my and Rep. Snitchler’s names and provided the people of Ohio with accurate information,” said Sears. “As a mother, there is nothing more important than protecting our children and keeping our communities safe. Fear mongering should not have been used to try to frighten parents and sway their votes.”

OHD-18: Matt Patten Lied About Voting to Cut His Pay

...but don't take my word for it, check out this PolitiFact piece:
The pay cut was actually a Republican idea before Democrats seized it. Rep. Seth Morgan, a Dayton-area Republican, included the 5-percent pay cut bill idea as stand-alone measure in House Bill 210, which was introduced on June 9, 2009.

That bill went nowhere for months. Democrats latched onto the idea in October 2009 and inserted the 5-percent pay cut plan into a measure that delayed a 4.2 percent state income tax cut for all Ohioans.
The so-called freeze on the income tax cut provided $844 million the state needed to shore up its budget, which had a hole in it after legal wranglings halted a plan to raise revenue by allowing slot machines at Ohio's horse tracks.
Republicans saw the freeze as a tax increase, so the bill containing the freeze and the pay cut passed on a mostly partisan vote. Only two Republicans joined all 53 Democrats in voting for it. Later, the Republican-controlled Ohio Senate stripped the provision from the legislation, so it never actually became law.
So Patten and the other House Democrats did vote to cut their own pay, right? Not so fast, dear reader.
A section of the the Ohio Constitution actually prohibits members of the General Assembly from changing their own pay.
    ...
Patten and other House Democrats are making an issue out of a vote that purported to cut lawmakers’ pay by 5 percent.
They claim they cut their own pay in the measure which ultimately wasn't adopted.
However, even if the measure had been adopted, the Ohio Constitution would have prevented the pay from taking effect until the next General Assembly is seated.
So they actually didn't vote to cut their own pay. They cut the pay for members of the next legislature, which may or may not include them.
Therefore, we find this claim to be false.

Cincy Public Schools Are STILL Indoctrinating Students for Democrats

    An email from COAST:
As of Monday, the Cincinnati Federation of Teachers has resumed mis-using school property and personnel for partisan political purposes, aimed at securing the election of liberal democrats Congressman Steve Driehaus and Governor Ted Strickland.

COAST is sending a letter to Steve Driehaus and Governor Strickland today asking that they demand the electioneering inside Cincinnati Public Schools on their behalf cease immediately.
Many folks have commented to COAST that the CPS voting scandal is so outrageous that they would not believe the facts if COAST's attorneys had not established an iron-clad case in Court. After all, why would largely honest public servants allow this abuse of tax resources to be used for political purposes?
Thus, imagine COAST's surprise Tuesday morning when CPS's attorney announced to COAST about new campaign activities of the Cincinnati Federation of Teachers using the property of Cincinnati Public Schools:
We learned that the CFT through its building representative placed in the mailboxes of its members at Western Hills High School the attached material that you may regard as a political advertisement within the scope of the 2002 Agreement. We are told that the material is paid for and prepared by AFT/OFT/CFT.
A copy of the attachment to the e-mail is here. You really will not believe it. It is overt electioneering on behalf of democrats Steve Driehaus and Ted Strickland. COASTers may recall that the activists taking three van loads of CPS students to the Board of Elections to vote democrat were wearing Driehaus campaign stickers and handing out democrat sample ballots.
COAST attorneys then inquired whether the abuse of school property for political purposes was going to spread to all CPS schools. CPS' attorney responded:
CFT counsel confirms today that the materials at Western Hills Engineering were to be delivered by CFT building reps to all CPS schools for distribution to teachers through the mailbox. While we have not polled every school, we have no reason at this time to think that is not the case. Let me know if your client would like to reciprocate.
We know COASTers are speechless in reading this. We were speechless when our attorneys forwarded us these messages as well.

After a week of withering criticism in the media and from the public about the ice-cream-for-votes scandal, CFT and CPS are again shamelessly mis-using government property for partisan political purposes. And the center of that political activity seems to be Congressman Steve Driehaus.
There appears to be no way to stop the use of CPS property before the election for political purposes. Rather than educate our children, CPS appears hopelessly dedicated to advancing the agenda of the ideological left -- and to use our tax dollars in doing so.
So, Congressman Driehaus and Governr Strickland, please instruct your minions to stop the abuse - and stop it now!
Public schools should not be used for indoctrination...but they are...and this is further evidence of it.

Butler County: Sheriff Spotlight STILL Doesn't Get It

Check out this piece over at the Cincinnati Enquirer about Sheriff Rick "Spotlight" Jones once again running to the media to cry about money.

This time, Sheriff Spotlight wants over $2,000 to attend a conference in Florida.

Butler County Tea Partiers ought to take notice of fights like these and start asking the guy some serious questions...

Hey, Sheriff, I'll start taking you seriously when you finally start taking the financial situation we are in seriously...

I'd actually like to see Commissioner Chuck Furmon go even further with cutting these sorts of things from the budget.

ERRATA: That conference is in California, not Florida...

UPDATE: Why is Spotlight holding a fundraiser with less than a week to go until E-Day when he isn't on the ballot?  Because Spotlight is all about Spotlight.

Ohio House Repubs Say Advertisements Instill Fear in Ohioans; May Be Coordinated Attacks

    Release:
COLUMBUS –Two weeks before one of the most influential mid-term elections in a generation, an organization known as “Our Future Ohio” has surfaced in Ohio to benefit struggling Democratic candidates throughout the state.

“Ohio has a new ominous hazard that will assist the Ohio Democrats' efforts to steal the election from voters who have had enough of their oppression,” said House Republican leader William G. Batchelder (R-Medina). “Questions need to be answered about this threat. How did “Our Future Ohio” file on a Thursday and have fully produced political ads just two days later?”
To date, the group has spent more than $2.3 million to attack leading gubernatorial candidate John Kasich and Ohio House candidates Matt Carle and Ron Young. “Our Future Ohio” has named Alan Melamed as their spokesman. Melamed is the President of Melamed Communications, and the company’s website lists the House Democratic Caucus and Speaker Armond Budish (D-Beachwood) as clients.
“This reeks of impropriety surrounded with so many questions that the public should know,” said Asst. Leader Louis Blessing (R-Cincinnati). “Coordinated expenditures between a corporate-funded PAC and candidates is illegal. The facts remain; Mr. Melamed, a self-proclaimed “chief strategist” for the Speaker, House Democratic Caucus and Melamed Communications, has been paid as a vendor by the House Democratic Caucus and House Democratic campaigns.”
Batchelder further stated that the Ohio House Republican Organizational Committee intends to file an elections complaint with the Ohio Elections Commission against “Our Future Ohio” and the House Democratic Caucus for illegal coordination. He expressed great concern and urgency that Secretary of State Jennifer Brunner institute her own investigation into this scandal.

Team Strickland Lies Again: This Time It's About Guns

    Release:
Columbus – Today charges were filed with the Ohio Election Commission accusing Ted Strickland’s campaign of deliberately and knowingly lying about John Kasich’s record in support of gun owners’ rights and the Second Amendment. The charges were filed by Rep. Danny Bubp (R-West Union), a life member of the National Rifle Association (NRA) with an A+ rating who was endorsed by the NRA in this year’s election.

Specifically, the charges accuse the Strickland campaign of falsely stating that John Kasich has an “F” rating by the NRA when, in fact, he has a “B” rating.
Rep. Bubp issued the following statement:
“John Kasich is the most long-suffering man I know because he’s risen above more smears and attacks during this campaign than probably anybody in recent political history. I shared my frustration with him last week over the Strickland campaign’s lies about his gun record so when the campaign asked me to file this complaint on its behalf I did not hesitate.
“I’m a proud NRA member which is why I am outraged that Ted Strickland is lying about John Kasich’s NRA rating. The NRA’s ratings are deliberate and thorough and Ted Strickland does not have the authority to simply try to rewrite them to try to make himself look better. It not only amounts to an illegal act, but I believe it’s a slap in the face of the NRA and of gun owners. It’s time for Ted Strickland to be held accountable.
"John Kasich likes to say that he’s probably agreed with the NRA more than his wife. He’s a gun owner with a solid B rating and that’s nothing to sneeze at. John Kasich is a gun owner who understands the power and importance of the Second Amendment and who shares the same passion for it that I do. On top of that, he put his beliefs in action and selected a running mate with a strong "A" NRA rating—Mary Taylor. If Ted Strickland supports the Second Amendment so much why does he keep picking running mates who are avowed enemies of the Second Amendment? His current Lt. Gov. Lee Fisher was a member of the board of directors of Handgun Control, Inc. and his current running mate, Yvette McGee-Brown, has an “F” rating from the NRA.”
On Friday, October 22, in an email to reporters, Ted Strickland’s campaign urged reporters to attend Strickland’s schedule of public events on Sat., Oct. 23 by sending them an email that read:
“Strickland will contrast his record of creating jobs and protecting the rights of sportsmen and gun owners with Congressman John Kasich's record of supporting outsourcing and his 'F' rating from the National Rifle Association.”

John Kasich has a “B” rating from the National Rifle Association, which can be seen on the NRA’s website below and here: www.nrapvf.org/upcoming-elections/Ohio.aspx

If, upon reviewing the complaint, the Ohio Elections Commission decides that there is probable cause that the Strickland campaign has committed a crime, the Strickland campaign will be put on trial before the commission.

A copy of the complaint can be viewed here.

OH-18: 60 Plus Association: Bob Gibbs is a “Fighter for the Elderly”

    Release:
Lakeville, OH – The 60 Plus Association – a national non-partisan senior citizen group – selected Bob Gibbs as the recipient of the Honorary Guardian of Seniors’ Rights award. With less than two weeks to go until Election Day, this recent endorsement is evidence that the momentum is on Gibbs’ side. After supporting his party’s healthcare bill that includes substantial cuts to Medicare, it is clear that Zack Space isn’t looking out for the interests of seniors. If elected, Gibbs would continue to work hard to protect seniors’ Social Security and Medicare.

“I am honored to be granted the Honorary Guardian of Seniors’ Rights award,” said Bob Gibbs. “Protecting seniors’ Social Security and Medicare is of the upmost importance to me. If elected, I promise to continue to work tirelessly on the behalf of Eastern Ohioan seniors.”
Legendary singer and spokesman for the 60 Plus Association, Pat Boone, had the following to say about Gibbs:
“‘The Association’s Guardian Award is presented to Democrats and Republicans in Congress based on their ‘senior friendly’ voting records. The Honorary Award is given to those running for office and is based on their views on seniors’ issues.
“‘Bob Gibbs can always be counted on to protect Social Security and Medicare,’ Boone said. ‘Bob Gibbs will be a tax cutter, protecting the pocket books of senior citizens. 60 Plus calls on nearly 5.5 million seniors nationally for support, so I believe I can speak on behalf of seniors when I say that they can count on Bob Gibbs. Clearly, seniors will have no finer friend in Congress than Bob Gibbs.’” (“Music Legend Pat Boone Sings Praises of Bob Gibbs,” 60 Plus Association Press Release, 10/22/2010)

Butler County Dems Still Using 2006 Playbook: Lying About Republicans

Once again, Mikey Pitman is doing the Democrats dirty work.  This time, he's got a piece that attacks Republicans in Butler County for ethics problems that happened years ago and by people who are no longer affiliated with the party.

And he kisses up to the Butler County Democratic Party with this ridiculous statement from the chairwoman Jocelyn Bucaro:
“For too long, local Republican elected officials have violated the ethics and criminal laws of Ohio, only to say they did not know their conduct was illegal. At no time have they expressed a desire to reform government or commit themselves to a higher ethical standard. If ignorance really is a defense to misconduct, then now is the time for education.”
That bolding is in the original...

Nevermind the fact that Jo has her own little ethical dilemma on her hands...but has she met Auditor Roger Reynolds or Treasurer Nancy Nix?  The new blood in the Butler County GOP is all about straightening out the mess left behind (note the past tense) by those who Jo uses to castigate the majority of voters in this county.

Granted, there is still a LOT of work to do, but let's not pretend Butler County is still being run by folks who look inept at ethics challenges when compared to Cuyahoga County Democrats...

MIKEY: You can reach the Butler County Republican party at (513) 893-5292...  Just trying to help...

OH-18: Space Fails Eastern Ohioans, Unemployment at Unacceptably High 10 Percent

      Release:
Lakeville, OH – State unemployment numbers were released this morning, and Ohio’s unemployment rate is at an unacceptable level of 10 percent today with 17,000 jobs lost in the past month, which is a clear indication that Zack Space’s job-killing agenda has failed Eastern Ohioans. Rather than seeing economic recovery, middle-class families continue to see pink slips as Ohio’s economy continues to spiral downwards. After rubberstamping a destructive economic agenda that includes a failed trillion-dollar stimulus, a cap-and-trade national energy tax and reckless spending – Space has repeatedly let middle-class families down.

“Zack Space’s destructive economic agenda has driven Ohio’s economy off a cliff,” said Gibbs Spokeswoman Emily Pettigrew. “Today’s news of Ohio’s unemployment rate hovering at an unacceptably high 10 percent is the clearest indication that Space’s time in Washington is up. As Ohio’s economy continues to struggle, will Space finally admit that unemployment is a problem?”
If elected, Bob Gibbs would focus on rebuilding the economy and putting Eastern Ohioans back to work.

BOEHNER: Ohioans Are Asking ‘Where Are the Jobs?’

      Release:
WEST CHESTER, OH – Congressman John Boehner today renewed his call for immediate enactment of Republicans’ Pledge to America to help end economic uncertainty after the Ohio Department of Job and Family Services reported that Ohio’s jobless rate remained in double-digits for an 18th consecutive month in September.

“In February of 2009, President Obama signed the ‘stimulus’ into law amid promises that it would create jobs ‘immediately’ and hold unemployment below eight percent. Since then, millions more Americans have lost their jobs and the national unemployment has topped 9.5 percent.
“Here in the Buckeye State, more than 100,000 people have lost their jobs since the ‘stimulus’ was enacted. Unemployment has remained at or above 10 percent for 18 straight months. Middle-class families and small businesses across Ohio are joining Americans in asking ‘where are the jobs?’ Out of touch Washington Democrats still have no answers.
“With the Pledge to America, Republicans are offering a new and better way to address the people’s priorities, starting with a plan to create jobs and end economic uncertainty. This governing blueprint, which was built by listening to the people, starts with stopping all the looming tax hikes and ending Washington’s out-of-control spending spree. Make no mistake, our economy will ultimately recover, but it will do so because of the hard work and entrepreneurship of the American people, not more of the same wasteful Washington spending and job-killing tax hikes and mandates

ALEC: Ohio Ranks 42nd in Economic Outlook

      Release:
SIDNEY, OH - According to the latest edition of an annual study by the American Legislative Exchange Council (ALEC), Ohio's economic outlook ranks 42nd out of the 50 states. As states face their toughest budgetary climates in a generation, the third edition of Rich States, Poor States: ALEC-Laffer State Economic Competitiveness Index offers a clear cut roadmap to prosperity.

"We cannot spend, borrow, or tax our way into prosperity," said Representative John Adams, Ohio House Minority Whip and ALEC State Chair. "State government must learn to live within its means, as we continually look for ways to make our great state more competitive and cultivate a business climate that will produce jobs."

While the state boasts of leading the nation in "green job" creation, Ohio's anti-growth policies have taken their toll on the state's overall economic outlook. When you add Ohio's local income tax rates to the state income tax, taxpayers face some of the highest rates in the nation.

Additionally, the study gives Ohio substandard marks for its poor labor policy and one of the worst state-level death taxes in the nation. Among bordering states, Indiana ranks 20th, West Virginia ranks 27th, Michigan ranks 26th, Kentucky ranks 40th, and Pennsylvania ranks 43rd.

Co-author and renowned economist Dr. Arthur B. Laffer summarized the report's findings when he said, "Tax and economic policies are essential to the competitiveness of our states." Rich States, Poor States presents state economic outlook rankings based on public policies that have a proven impact on growth, revealing which states have the best chance of experiencing economic recovery, and which need to re-examine their policies before they can expect to see improvement.

Laffer and his co-authors, Stephen Moore, senior economics writer at The Wall Street Journal, and Jonathan Williams, director of ALEC's Tax and Fiscal Policy Task Force, analyzed how economic competitiveness drives income, population, and job growth in the states.

"Our research shows that states with responsible spending and competitive tax rates enjoy the best economic outlook," Williams said. "States do not enact changes in a vacuum - every time they increase the cost of doing business in their state, their state brand immediately loses value."
Take that Ted Strickland (and Jon Husted)!

Last Friday, I wrote in Money Talk that Rob Portman could catch some of the blame if he wins while Ohio Republicans lost the Apportionment Board.  Enter National Review's Mytheos Holt on Monday with a piece about Portmans "Ohio's Future PAC" which really doesn't address exactly what I was talking about but does demonstrate that Portman is well aware that there is more at stake than just a US Senate seat.

A quick search over at Open Secrets shows plenty of donations to Republicans in and out of the great state of Ohio.  I spot checked a few of the "big" names on the expenditure report and the last donation to a statewide candidate was to Josh Mandel...in April.  That data is based on information released on September 30th, so it is possible that Ohio's Future has donated to statewide candidates this month, but...

Mr. Holt should have dug a little deeper...

I have an email in to Team Portman to see if Ohio's Future has made any donations lately.

On Jefferson, Church and State, and the Constitution

Over on Facebook, I've been engaged in a lengthy discussion about Thomas Jefferson and the "separation of church and state" as it applies to Constitutional issues and the First Amendment.  This whole thing got started when I chided a friend of the Libertarian persuasion for having re-Tweeted Joy Behar's ridiculous cackling towards Chritine O'Donnell.

My position is this: Separation of church and state does NOT appear in the Constitution or the First Amendment, and it doesn't.  The Supreme Court wrongly went to Jefferson's Danbury Letter when trying to decide Reynolds vs. the United States.  Once again, an activist court imposed their views on the law rather than actually using the Constitution and its Amendments for the basis of their decision.

Subsequent members of the Supreme Court have lamented this gross misinterpretation: (Source)
In 1962, Justice Potter Stewart complained that jurisprudence was not "aided by the uncritical invocation of metaphors like the 'wall of separation,' a phrase nowhere to be found in the Constitution." Addressing the issue in 1985, Chief Justice William H. Rehnquist lamented that "unfortunately the Establishment Clause has been expressly freighted with Jefferson's misleading metaphor for nearly 40 years."

      Jefferson's real intent:
The unedited draft of the Danbury Baptist letter makes it clear why Jefferson drafted it: He wanted his political partisans to know that he opposed proclaiming fasts and thanksgivings, not because he was irreligious, but because he refused to continue a British practice that was an offense to republicanism. To emphasize his resolve in this matter, Jefferson inserted two phrases with a clenched-teeth, defiant ring: "wall of eternal separation between church and state" and "the duties of my station, which are merely temporal." These last words -- "merely temporal" -- revealed Jefferson's preoccupation with British practice. Temporal, a strong word meaning secular, was a British appellation for the lay members of the House of Lords, the Lords Temporal, as opposed to the ecclesiastical members, the Lords Spiritual. "Eternal separation" and "merely temporal" -- here was language as plain as Jefferson could make it to assure the Republican faithful that their "religious rights shall never be infringed by any act of mine."
What does this mean?  I think Jefferson was saying that he felt that the Constitution limited government, not religion.

This article on the Danbury Letter is a quite fascinating read.  Check it out if you are interested in such things.

UPDATE:  Later in that article is this interesting tidbit:
One of the nation's best known advocates of religious liberty, Leland had accepted an invitation to preach in the House of Representatives on Sunday, Jan. 3, and Jefferson evidently concluded that, if Leland found nothing objectionable about officiating at worship on public property, he could not be criticized for attending a service at which his friend was preaching. Consequently, "contrary to all former practice," Jefferson appeared at church services in the House on Sunday, Jan. 3, two days after recommending in his reply to the Danbury Baptists "a wall of separation between church and state"; during the remainder of his two administrations he attended these services "constantly."
Emphasis added.  And we are supposed to belive that Thomas Jeffferson was so dedicated to the idea that religion had no role in politics...

UPDATE 2: Sometimes in getting wrapped up in the history, I forget to address the actual issue at heart of the discussion.  Fortunately, Ramesh Ponnuru does that nicely here:
“Some bloggers and tv commentators have seized on remarks by Christine O’Donnell to suggest that she is unaware that the First Amendment prohibits the establishment of religion. I don’t think that’s right. What she denies is that the First Amendment requires ‘the separation of church and state.’
Exactly.  But I don't expect those folks who don't get it to ever acknowledge that she is actually making a very important argument that many Americans don't understand.  Why?  For the most part, our education system has robbed the citizenry of critical thinking and reading comprehension skills.  This is exactly the sort of circumstances that produce a culture obsessed with American Idol and other nonsense while the nation faced decline for the bulk of my adult life.

OHD-18: Dovilla Endorsed by Plain Dealer

      Release:
In its endorsement of U.S. Navy combat veteran and small business owner Mike Dovilla, The Plain Dealer on Sunday made a clear distinction between the independent-minded Dovilla, “a serious policy wonk,” and community organizer Matt Patten, “an affable but unremarkable first-term incumbent,” who has voted with his own party in the legislature 98.9 percent of the time. Dovilla has also been endorsed by U.S. Senator George Voinovich, Mayor Robert Blomquist of Olmsted Falls, Mayor Thomas Perciak of Strongsville, the Associated Builders and Contractors’ Northern Ohio Chapter, National Defense Committee, National Federation of Independent Business/Ohio, Ohio Chamber of Commerce, The Ohio Manufacturers’ Association, Ohio Patrolmen’s Benevolent Association, Ohio Restaurant Association, Ohio Right to Life, Ohio Society of Certified Public Accountants, Ohio State Medical Association, Ohio Veterans United, Republican Party of Cuyahoga County, and The Liberty Committee.

      Ohio House District 18

      MIKE DOVILLA

      Age: 35

Experience: government affairs consultant, former U.S. Senate staff member, Navy reservist.

      Party: Republican
Why him? This is the toughest call in the Cuyahoga County delegation. Affable but unremarkable first-term incumbent Matt Patten has stayed predictably close to the Democratic Party line. Dovilla is a serious policy wonk who wants to make state government more efficient and get more dollars into classrooms by cutting overhead. A former aide to Sen. George Voinovich, Dovilla would be a good addition to the House if he can channel some of his old boss's independence.

Reason #8537127357482109837 NOT to Trust Republicans From California Not Named Reagan

Quote of the Day from Rep. Darrell Issa (RINO-CA):
"It's pretty clear the American people expect us to use the existing gridlock to create compromise and advance their agenda," said Rep. Darrell Issa (R., Calif.). "They want us to come together [with the administration] after we agree to disagree."
Exactly wrong.  We want the administration to come to us after they agree to disagree.  It is the administration and the Democrats in Congress who pushed their socialist agenda that the American people have rejected.  It is their move to make in coming back to the center; it is NOT our move to go to the left again.

OHD18: Dovilla Receives Ohio Manufacturers’ Endorsement

      Release:
COLUMBUS – The Ohio Manufacturers’ Association Political Action Committee (OMA-PAC) has announced its endorsement of Mike Dovilla (R-Berea) in his candidacy for the 18th District Ohio House race for the upcoming November election.

“Our goal is to help elect the most qualified candidates to protect and grow Ohio manufacturing,” said OMA president Eric Burkland. “With today’s endorsement, we’ve taken an important step in accomplishing that goal. Mike Dovilla supports the issues that are important to Ohio manufacturers and their employees and understands that a strong manufacturing sector leads to a healthier economy, good jobs and improved quality of life for all Ohioans. We are pleased to support him.”

Candidate endorsements are made by the OMA-PAC board of directors based on a variety of information including public records and member support in the district.

“I am honored to be endorsed by The Ohio Manufacturers’ Association. As a consultant to an Ohio-based U.S. Army Center of Excellence that partners closely with local metals manufacturers, I understand the importance of manufacturing to our state’s economy. We must work to restore a business-friendly climate to Ohio that allows these companies to grow and create jobs for Ohioans. When I am elected to the legislature, I will work closely with Ohio’s manufacturers to ensure they have an economic environment in which they can compete and succeed.”

OH-18: Rep. Space (D) Claims National Energy Tax is a Good Thing

      Release:
Lakeville, OH – In a recent New York Times article, the Zack Space campaign again claims that the national energy tax – which Space supported – would be beneficial for Ohio industries. After previously stating that he doesn’t believe Eastern Ohio has an unemployment problem, this newest gaffe is proof-positive that Space is truly out-of-touch with the needs of Ohioans. If signed into law, Space’s national energy tax could result in more than 100,000 jobs lost and would mean higher taxes for struggling middle-class families and small business owners.

“‘That bill, the whole thing, has been about investing in the energy sector,’ Andrew Ricci, Space's campaign spokesman, said of the climate bill last week. ‘Ultimately, it's a good thing that's going to benefit those industries’ in Ohio.’” (Evan Lehmann, “In Ohio's Coal Country, Climate Policy Is a Tough Issue,” New York Times, 10/14/2010)
“Not only did Zack Space rubberstamp tax-hiking and job-killing legislation, but he’s trying to fool voters into believing it’s good for the region,” said Gibbs Spokeswoman Emily Pettigrew. “His recent comments are indicative of how he’s represented Ohio families over the past two years – out-of-touch. Now, after repeatedly supporting legislation that Eastern Ohioans flatly reject, Space may find himself out of a job this November. “
Unlike Space, Bob Gibbs soundly rejects the Democrats’ job-killing legislation. If elected, Gibbs would fight to keep energy costs low and keep hard working Ohioans in their jobs.

      Money Talk

One of the things that I will never forgive Jon Husted for is hanging on to all that fat cash when he left the Ohio House for the Ohio Senate while we lost a few races that made the difference between Speaker Budish and Speaker Batchelder.  Would it really have made a difference?  Probably not, but we'll never know now will we?  It sure would have made it feel like Husted gave a kitty about the disaster he left behind in the rear view mirror...

      Anyway...

I think it is about time we start talking about how if Rob Portman does trounce Lee Fisher like shooting fish in a barrell on E-Day and the bulk of the ticket crashes and burns, then maybe Rob might get some of the blame.  And if you are thinking similar thoughts about Josh Mandel, think again because I think that is still a tight(er) race than we think.

Rasmussen has Portman up like 20 points for goodness sakes.  And $6 million on hand...

I am not a campaign finance expert by any stretch of the imagination; so maybe this is impossible to fix now.  But if guys like Dave "I'm a Prosecutor, not a Politician" Yost go down in flames due to an imbalance in funds ("Little Orphan" David Pepper-Warbucks is gonna drop some serious coin to win) and we wind up losing the Apportionment Board (the most imprtant thing since "air" in this election cycle) won't somebody start looking at the guys who have all the cash (and yeah, Jon Husted, I'm STILL looking at you) and start asking questions?

RINO Former Candidate Donates to Rep. Fudge (D)

Just another one of them outstanding "moderate" Republicans that the establishment loves so much...

UPDATE:  Establishment hack and Victory Chairman Kent Moore was not sought out for comment, but probably should have been...heck, he's probably a contributer to Fudge too for all we know.

OHD-28: OEC Calls for Investigation On Dirty Democrat Ad

      Release:
COLUMBUS–The Ohio Elections Commission has ruled unanimously in a lawsuit filed against the Ohio Democratic Party (ODP), which was in response to a campaign mailer slandering House candidate Mike Wilson. Specifically, the mailers falsely claim that Wilson wants to cut funding for police and safety forces.

The elections complaint was filed by military veteran Chris Hammond, who contested numerous slanderous statements by the ODP. The suit states that House Bill 400, the bill in question, does not provide which programs would be streamlined if the income tax is phased out. The bipartisan probable cause panel voted 3-0 that there was reason to believe that the ODP had lied in this statement about Mike Wilson.

Additionally, the Ohio Elections Commission yesterday ruled unanimously that there is probable cause to believe that the Ohio House Democratic Caucus made false accusations in a televised campaign ad slandering Wilson. Specifically, the television ad claims that Wilson wants to cut programs that assist military veterans.

“The reason why Connie Pillich and her supporters are airing these false ads is that they are trying to misdirect from their own poor record,” said Wilson. “Connie Pillich voted to raise taxes on all Ohioans including our veterans, our seniors and our families. Additionally, she cut state funding to our schools. Based on that track record, I can assure veterans, seniors and families that they will get better treatment from me than they got from Pillich.”

The Ohio House Republican Organizational Committee called for an end to the false attacks from Democrats.

“The desperate claims against Mike Wilson are ludicrous, and Connie Pillich and her supporters should cease and desist any further airing of such attacks,” said Ohio House Republican Organizational Committee director Mike Dittoe. “Mike Wilson has long been an advocate of our state’s first responders like police and firefighters. This desperate attempt to once again skew House Bill 400 is the same, tired scheme from the tired Democratic playbook.”

The Ohio Elections Commission will now have a full hearing on the issue at a later date. If an ad is found in violation of state law, the Ohio Elections Committee can refer the matter for criminal prosecution or assess other penalties.
I saw that ridiculous ad on Fox19 again this morning.  Still ticks me off that these people are lying like this, but that's what Democrats do...

UPDATE:  Exit Question: Will the Enquirer (or any other 527 Media outlet in this state for that matter)EVER report on Connie Pillich's lies???

Elections Commission Rules Against Ohio Democratic Party AGAIN

      Release:
COLUMBUS—The Ohio Elections Commission today ruled that the smear campaign launched by the Ohio Democratic Party (ODP) against State Rep. Todd Snitchler (R-Uniontown) is false. The ruling discredited a mailer comparing Snitchler to an image of a rat, which claimed that he was investigated three times in election-law violations and that he wrongly claimed to have held a leadership position in the Ohio General Assembly.

“I’m pleased by the ruling today, but it’s still very disappointing that a lawsuit had to occur to stop such a heinous character assault,” said Ohio House Republican Organizational Committee Director Mike Dittoe. “It is this sort of dirty political tactic that has made people resentful of politics and politicians. In my opinion, the ODP proved that they are deceitful and untrustworthy—neither of which the people of Ohio want in the Statehouse.”

The elections complaint was filed by North Canton resident Elizabeth Griffing, who contested numerous slanderous statements by the ODP. After a unanimous vote by the probable cause panel, the Ohio Elections Commission voted that these claims are, in fact, false and in violation of Ohio elections law.

“I believe that justice was upheld today,” said Griffing. “The Ohio Democratic Party has resorted to dirty politics to tarnish the reputation of a father, small business owner and genuinely concerned Ohio citizen, and they should be held accountable for resorting to dishonest politics.”

OHD-28: Politics Extra (Enquirer) Covering for Pillich?

When will Politics Extra (Enquirer) get around to reporting the OEC decision that Connie Pillich cut School Funding?  The World wonders...

We know somebody was there because they have reported on the probable cause finding in the Driehaus vs Susan B. Anthony case...  Is there an agenda on display over there?

      Strickland Raised Our Taxes

...but don't take my word for it, check out what PolitiFact has to say:
Those who owed the state after filing their 2009 taxes, owed a little bit extra thanks to Strickland’s tax freeze. Strickland’s decision cost a family of four earning $60,000 a year about $78 last year.

Strickland prides himself on having made tough decisions in rough economic times. One of those decisions was postponing the income tax cut which meant taking money out of the pockets of Ohioans.
But while the freeze is expected to be lifted next year, there are no guarantees that will happen in what is still a rough economic landscape for Ohio. And state taxpayers, who had to pay more in income taxes than what had been promised, may continue to pay at the higher rate.
We rate Kasich’s statement Mostly True.
Remember this the next time some liberal lies to you and says that Ted Strickland didn't raise your taxes because he most certainly did raise your taxes.

And, yes, he did it with the help of a few Senate RINOs like Harris and Niehaus...and their betrayal won't be forgotten either.

OHD-28: OEC Says Pillich Cut School Funding

      Release:
COLUMBUS—The Ohio Elections Commission today found that the House Democratic Caucus had no probable cause in a lawsuit, which was filed in response to a campaign mailer and that the complaint had no merit. The mailer asserted that Reps. Connie Pillich and Nancy Garland voted to cut state school funding by $32 million, a figure that the Democratic Caucus claims is false. However, the panel found that there is no probable cause to believe that the literature contained false statements.

“I’m very pleased with the panel’s ruling today,” said Ohio House Republican Organizational Committee chairman Matt Huffman (R-Lima). “Although the Democratic Caucus attempted to distract from their candidates’ records by filing frivolous elections complains, the truth and facts were verified by the panel’s decision, they did in fact cut state funding to Ohio schools."

The House Democratic Caucus Fund filed the lawsuit against the Ohio Republican Party. The bipartisan probable cause panel of the Ohio Elections Commission voted unanimously that the lawsuit on behalf of Reps. Pillich and Garland was without merit, lending validity to the claims against their records on cutting state school funding."

“With this ruling, I hope that the Ohio Democratic Caucus will start answering for their voting records, rather than hiding behind the politics of distraction,” Huffman said.

400 More Jobs Lost in Strickland's Economy

      I blame Wall Street.

Avon is cutting 400 jobs and shipping them off to Illinois, New Jersey, China and Mexico but somehow all of this will be John Kasich's fault when we see Strickland's next ad.  Of course, the 527 Media in this state will go along toget along because Ohio hasn't suffered enough.

      LEHMAN BROTHERS!!!

Former St. Rep. Young Receives “For Good Government Award”

      Release:
Mentor, OH—The United Conservatives of Ohio (UCO) has awarded former State Rep. Ron Young (R-Mentor) the “For Good Government Chairman’s Award” today for “spearheading a successful effort in 2002, to protect taxpayers from income tax increases resulting from inflationary impacts of bracket creep,” wrote UCO Chairman Ron Amstutz in a letter to Young.

Bracket creep is the tendency for individuals’ incomes to creep into a higher tax bracket because of nominal increases in income, even when the real value of that income has not increased. The periodic adjustment of tax brackets for inflation is known as “indexing,” which is designed to prevent bracket creep from occurring.

“I am honored and humbled to be recognized for this effort,” said Young. “Lawmakers should always strive to improve state government and minimize the impact on the taxpayers, and I think that my efforts to introduce legislation in 2002 provided that vital step.”

The income tax indexing provision was ultimately enacted in 2002 as an amendment to a budget measure and was scheduled to begin in 2005. However, House Bill 66 of the 126th General Assembly delayed the indexing until 2010. When unveiled again in August of this year, the Ohio Department of Taxation lauded this measure as “a move that will save Ohioans an estimated $25 million annually starting with the returns due next spring.”

OHD-28: Pillich (D) is PRO-Tax, Calls Press Conference to Prove It?

Statement from Hamilton County GOP Chairman Alex:
"The latest political stunt by Rep. Pillich regarding a mysterious $100 bill supposedly mailed on her behalf can only leave voters in the 28th House District scratching their heads about the type of legislator she is and the type of campaign she is running. This afternoon, Rep. Pillich called a press conference to announce major, breaking, and critical information to the public and to her constituents. Allegedly, someone wrote a letter with a $100 cash donation to the opponents of a tax levy campaign claiming the donation came from her and according to news reports, it mysteriously ended up in Pillich's mailbox instead of at its intended recipient. How convenient. Ms. Pillich then notified the press and attempted to make this a campaign issue. She also contacted the police department.

"In a universe where Pillich has left many of us scratching our heads at her decision-making for two years, today's conspiratorial allegations have reached bizarre proportions-even for her. If one is to believe Ms. Pillich's assertion, someone tried to set her up as being anti-tax by pretending to be her and making it seem like she was against a tax levy and then conveniently sent her the supposed evidence. Wouldn't that be a stretch for a liberal Democrat?
"If one were to believe that Mike Wilson had anything to do with this, one would have to believe that Mr. Wilson hopes to paint Ms. Pillich as a person opposed to additional taxes. What planet does Ms. Pillich reside upon?
This bizarre, silly antic by Ms. Pillich and her supporters is exactly why we need serious change in the 28th House District."
Alex is right.  This is a wacky stunt and the amazing thing is that it doesn't help her cause at all either.

      OH-06: Charlie Wilson, Spouse Abuser

This is what OH-06 has representing them in Congress.  I knew this guy was trash, but I had no idea...  On Nov. 2, OH-06 has a chance to do something about this situation...

OH-01: Chabot Understands What Has Happened to Driehaus

Check out his latest blog entry for the whole story, but after learning that the DCCC has pulled funding for Driehaus, this is the lesson Chabot relays:
So there you have it. The election’s over, right? We’ve got it in the bag. Uh, NO. We’ve got three more weeks of hard work to do. No one rests. No getting complacent. Confidence, yes. Overconfidence, no.

Let’s face it, it all comes down to which candidate gets the most votes BY Election Day, Tuesday, November 2nd, exactly 20 days from today. And although most of the votes will actually be cast on Election Day, up to 40% of the votes could be cast during the 35 day period before the election, between September 28th and November 2nd. In Ohio votes can cast by absentee ballot, or one can go to the Board of Elections at 824 Broadway.
The game is still on...let's run up the score!

OH-08: Dem's Poll Shows What We Already Know -- Also Ran Has NO CHANCE

I'd like to point out to Cox Newspaper's liberal scribe Mikey Pitman that that liberal poll he was gushing for is out and it shows pretty much what we expected: Justin Cousoulle is an Also Ran.

It looks like the people from this "organization" made the calls and did the analysis and wrote the questions. This is in no way a professional poll. There is no information about the sample. You don't think they have a bias here do you?

All that aside, let's take a look at the numbers anyway...

74% of those polled didn't even know who the hell Justin was...  Oh, yeah, he's the liberals great hope for this election.  Somebody ought to tell Justin that NOBODY in OH-08 watches MSNBS let alone that blowhard Ed Schultz.

HALF of those polled said they need more information just to determine whether or not Justin was a viable candidate.  A plurality (34%) already know that he isn't.

But the biggest news of this poll shows that Boehner wins 30.4% to 19.6% in a poll where Boehner has an Unfavorable Rating of 59% while 94% of these people are definitely going to be voting!

Oh, and Carl Weiser of the Enquirer, don't think I missed seeing you gush on this poll too...

OH-01: National Right to Life Refutes Driehaus

      Release:

      Congressman Driehaus uses criminal complaint in attempt to gag critics;

NRLC refutes his claims with sworn affidavit and documents

WASHINGTON -- The National Right to Life Committee (NRLC) has produced a sworn affidavit, submitted today to the Ohio Elections Commission, demonstrating that the Obama health care law does in fact provide federal subsidies for elective abortion.

NRLC's statement was filed at the request of attorneys for the Susan B. Anthony List ("SBA List"), a pro-life political action committee. On billboards posted in the Cincinnati area, and in other public utterances, officials of the SBA List have asserted that Congressman Steve Driehaus (D-Ohio, First District) "voted for taxpayer-funded abortion" when he voted to enact the Patient Protection and Affordable Care Act (PPACA), the Obama health care law.

In reaction to the SBA List's statements, Rep. Driehaus on October 5 filed a complaint with the Ohio Elections Commission, utilizing a peculiar Ohio statute under which it is a violation to make "a false statement concerning the voting record of a candidate or public official," or to "post, publish, circulate, distribute, or otherwise disseminate a false statement concerning a candidate, either knowing the same to be false or with reckless disregard of whether it is false or not . . ." [Ohio Revised Code 3517.21(B)(9) and (B)(10)] If the Commission votes that the disputed SBA List's statements were "false," the statute gives the Commission the power to either issue a public reprimand or to refer the matter to a county prosecutor with a recommendation for criminal prosecution. A criminal conviction under the statute is punishable by up to six months in jail and/or fine of $5,000.

A three-member panel of the Commission will hold an initial hearing on the Driehaus complaint on Thursday, October 14, at 8:30 AM in Columbus, Ohio.

In his complaint, Driehaus asserted, "Congressman Driehaus and like-minded pro-life Democratic members of the House of Representatives were successful in securing language in both the PPACA and Executive Order 13535, ensuring that the PPACA would not permit or be construed as permitting taxpayer-funded abortions. . . . Despite the fact that the PPACA does not permit and in fact prohibits taxpayer-funded abortions, the SBA List and other groups opposed to Congressman Driehaus's reelection have published and disseminated the false statement about Congressman Driehaus . . ."

At the request of the SBA List, NRLC submitted a 23-page affidavit, prepared and sworn to by veteran Federal Legislative Director Douglas Johnson, consisting of 65 numbered paragraphs, refuting Driehaus's claims. Paragraph 15 explains that the law that Driehaus voted for "contained multiple provisions that do in fact authorize (i.e., create legal authority for) taxpayer funding of abortion, and that predictably will result in such funding in the future -- unless the law itself is repealed, or unless the law is revised by a future Congress to include statutory language long the lines of the Stupak-Pitts Amendment." Paragraph 32 explains, "Some of these provisions are entirely untouched by any limitation on abortion in existing law or in the PCACA itself, and others are subject only to limitations that are temporary or contingent."

The affidavit provides detailed discussion of four specific programs under which abortion coverage is authorized by the PPACA -- the Pre-existing Condition Insurance Program (PCIP), the program of federal tax-based subsidies to purchase private health plans, the appropriation of $7 billion in new funding for Community Health Centers, and the section creating "multi-state" health plans to be administered by the federal Office of Personnel Management. The affidavit notes that these examples are not exhaustive.

In paragraphs 56-62, Johnson dismisses Driehaus's reliance on Executive Order 13535 as "highly misleading," noting, "There are no directives in the Order that apply to all, or even to most, of the provisions of the PPACA. The operative provisions that are actually contained in the Order are extremely narrow and highly qualified. . . Executive Order 13535 has the hallmarks of a primarily political document." Johnson also notes that the president of the Planned Parenthood Federation of America characterized the Executive Order as "a symbolic gesture."

NRLC attached 16 documents to the affidavit as exhibits, including a legal analysis of the abortion-related components of the law issued by the Office of General Counsel of the U.S. Conference of Catholic Bishops; documentation on state PCIP plans for Pennsylvania and New Mexico that were initially approved by DHHS although they covered elective abortions; a Congressional Research Service report that confirmed that nothing in the PPACA or the Executive Order prevented the use of PPACA-authorized PCIP funds from being used for abortions; and the texts of the Stupak-Pitts and Nelson-Hatch Amendments which were proposed to prevent any part of the legislation from subsidizing abortion -- but which were opposed by President Obama and congressional Democratic leaders, and which were not part of the law as enacted.

Both the NRLC affidavit and the collection of 16 documents can be viewed at or downloaded from the NRLC website at www.nrlc.org/AHC/DvSBA.

Beyond the contents of the affidavit, NRLC's Johnson offered these additional comments on the subject: "It is outrageous the Ohio law allows an incumbent politician, like Steve Driehaus, to haul citizens before an appointed government tribunal, under threat of potential criminal prosecution, for expressing an opinion about the public policy implications of a vote that he cast in Congress. This is an incumbent-protection law that is intended to intimidate critics, reminiscent of the methods used to chill criticism in certain countries run by presidents-for-life. In America, anyone should be free to express their views on the effects of the bills that Mr. Driehaus voted for, without fear of criminal prosecution or fines. Mr. Driehaus enjoys full freedom to dispute his critics, with the voters as the ultimate judges about whose claims are most credible. Mr. Driehaus apparently does not trust the voters to see things his way, and so he attempts to utilize criminal-law strong-arm tactics in a pathetic effort to intimidate and gag his critics."

As far as we know, Driehaus is the only incumbent, so far this year, to employ a criminal statute against his pro-life critics, but a number of other House Democrats are trying hard to suppress pro-life groups' criticism of their votes in favor of the health care law. For example, recently attorneys for Rep. Kathleen Dahlkemper (D-Pa., Third District) sent a letter to local radio stations suggesting that a radio ad charging that she voted for "taxpayer-funded abortions" was "slanderous."

More Ohio Democrat Lies in Ads Getting the OEC Treatment

      Release:
COLUMBUS—Last week, bus drivers, parents, community members and other residents of the 46th Ohio House District spoke out against a false political advertisement that is now the subject of an elections complaint before the Ohio Elections Commission. State Rep. Barbara Sears (R-Monclova Twp) today filed an elections complaint against the House Democratic Caucus Fund, candidate for District 46 Harry Barlos, candidate for District 50 Todd Bosley, and each of their campaign committees.

The complaint charges that the House Democratic Caucus Fund and the two Democratic candidates lied in two televisions ads, which accuse Rep. Sears and her colleague, State Rep. Todd Snitchler (R-Uniontown), of voting to allow schools to hire as bus drivers criminals convicted of molesting and abusing children. However, prior to House Bill 19, the measure in question, criminals convicted of molesting and abusing children were already prevented from being school bus drivers. Therefore, the television advertisements, blatantly lie about the effects of HB 19 on restrictions on hiring school bus drivers.

“This legislation actually weakened the restrictions on convicted criminals who could become school bus drivers,” said Sears. “I find it extremely disappointing and, quite frankly, insulting that the my opponent and his allies would spread blatant lies about this legislation in order to win an election—even if it means spreading fear throughout our communities. As a mother, there is nothing more important than ensuring that our neighborhoods are safe for our children, and I know that my colleague Rep. Snitchler, who is a father, feels the same way.”

A Toledo-area Channel 13 ABC “Truth Test” segment investigated the dubious claims made against Rep. Sears and concluded that they had no basis and were in fact false.

ENERGY UPDATE: Good Bye Moratorium, Hello Permitorium

      Release:
WH lifts deepwater moratorium in time for election; thousands will remain out of work due to lack of permits issued

Washington, DC – With the mid-term elections just over two weeks away, the Obama Administration today decided to lift the nearly 6-month ban on responsible offshore energy exploration, according an announcement Secretary Salazar made at a press conference this afternoon. Thomas J. Pyle, president of the Institute for Energy Research, issued the following statement, challenging the Interior Department to be straight with the America people on the de facto ban that remains in place:

“Today’s announcement is about politics and headlines, not getting folks back to work and increasing domestic energy exploration and production in the United States. The moratorium may very well be a thing of the past, but a permitorium remains the guiding policy of this Administration.

“What was announced today will result in no change in domestic energy production in the Gulf of Mexico until Interior Secretary Salazar begins to issue permits once again. In the meantime, thousands of gulf coast families will continue to be out of work. It can’t be explained any other way.”

      OEA Attacks Husband of Member

Over in the 93rd Ohio House District, the Ohio Education Association has released attack ads against the husband of one of their members.  Jade Thompson has taken a stand against this new low in a Letter to the Editor in the Marietta Times.  Her husband is Andy Thompson and he is a principled leader that doesn't deserve the abuse heaped upon him by uber-liberal organizations who have done far more damage to the state of Ohio than Andy's positions on the issues facing our great state.

Jade says it better than anyone:
There was a recent letter to the editor about AEP withdrawing its support from the Ohio Chamber of Commerce because the chamber made a political endorsement. The writer found it "inappropriate and shameful" for that organization to ignore its members. I wonder if she would say the same for the OEA, an organization that endorses the most liberal candidates in the field and which month after month promotes progressive causes and programs in its member newsletter. Are Ohio's teachers that unanimously liberal or does our union simply not represent our views at all? If teachers are representative of the larger voting public then you would expect that our political views would be just as diverse.
Teachers should be free to spend their hard-earned dollars to contribute to the candidates and causes they actually support. The OEA and its parent organization, the NEA, refuse to acquiesce because they have an obvious agenda. After all, as the general counsel for the NEA once said in federal court, "if you take away payroll deduction, you won't collect a penny from these people, and it has nothing to do with voluntary or involuntary. I think it has to do with the nature of the beast, and the beasts who are our teachers ... (They) simply don't come up with the money regardless of the purpose." Teachers, this is what your union thinks of you.

Roger Reynolds: Integrity in Public Service

One of the questions I get a lot deals with the qualities voters should be looking for in a candidate.  The guy I use as a measuring stick is Roger Reynolds.  As our Auditor in Butler County, Reynolds has delivered on the promises he made when he campaigned for the position.  Roger is committed to the 3 R's: Reducing Spending, Reforming Government, and Returning Tax Savings.

      Reduced Spending

Roger told us that he would reduce the spending and he has.  Roger has cut the budget by over $2 million and slashed spending by 35%.  And he isn't done yet!  He is committed to fiscal responsibility and is dedicated to making sure that every dollar spent is used wisely.

      Reformed Government

One of the areas that Roger is leading in is transparency.  Coming in to an office to clean up the mess of a scandal-plagued predecessor, one of the things that Reynolds did to demonstrate the integrity of the office was develop an online database of expenditures.  For the first time, county records were placed on the internet for citizens to be able to review.

By strengthening internal controls, Reynolds has restored integrity to the way the county does business. Twice the office has won the Certificate of Achievement for Excellence in Reporting which illustrates the level of professionalism and dedication that Roger's team has to the perfromance of their duties.  That is real leadership!

      Returned Tax Savings

After reviewing the numbers, Roger was able to return over a million dollars to communities in Butler County.  He discovered and eliminated an illegal tax assessment and levy.  Reynolds also donated an underutilized official vehicle to the Dog Warden.

      Roger Reynolds

Roger has participated in Town Halls so that he may hear concerns -- directly from constituents.  He has made doing business with Butler County more efficient by encouraging usage of electronic payments.  Customer service has improved considerably too.

There is a quote on Roger's campaign site that perfectly sums up who Roger is and what he is trying to accomplish: "I’m working diligently to save tax dollars, maximize services and build public trust.” He has kept his word and he deserves re-election.  He has earned my respect AND my vote.

      DCCC Surrenders OH-01

Today's great news of the day is that the DCCC is pulling its ad buy in OH-01.  It sure looks like the DCCC has read the writing on the wall and decided not use what resources they have elsewhere.  As much as we like to call Zack Space the Accidental Congressman, Steve Driehaus probably deserves the title more...

Bottom line: This is fantastic news for Steve Chabot, a man who has worked hard and worked smart for his return to Congress.

UPDATE:  I just had an idea: Steve Chabot should buy that ad time.  Click here and donate to help Chabot get his message out to even more people!

Team Wilson Fights Back Against the Lies from Team Pillich

      Release:
Columbus, OHOctober 11th, 2010: Former Sgt. Chris Hammond, USMC, filed two complaints with the Ohio Elections Commission alleging false statements on the part of the Ohio House Democratic Caucus, the House Democratic Caucus Fund and the Ohio Democratic Party. The complaints relate to a television ad that falsely attacks Mike Wilson’s positions on veterans’ benefits, as well as mail pieces that falsely assert that Mike Wilson has a plan that will force the layoff of thousands of police, firefighters and teachers.

According to Sgt. Hammond, “I filed these complaints because I know Mike Wilson to be a strong supporter of our military and our veterans and I believe these ads to be false. It is very disappointing that Representative Pillich’s Democrat allies would deliberately distort the truth in such a blatant way.” Sgt. Hammond continued, “As a fellow veteran, I know that Representative Pillich understands the value the military places on truth and honor. Connie Pillich dishonors her own service when she exploits other veterans to distort the truth on her behalf.”

Veterans across the region are outraged by the television ad which has appeared frequently on local stations. The ad contains a series of veterans attacking Wilson and questioning, “Why won’t Mike Wilson honor veterans?” The ads cite Wilson’s support for H.B. 400, a plan to reform Ohio’s tax code by phasing out Ohio’s income tax over 10 years.

“H.B. 400 does not implement any spending cuts and only schedules income tax rates to decline over a 10-year period,” pointed out Mike Wilson, Republican candidate for State Representative. “This plan is quite similar to one implemented successfully in Indiana by Governor Mitch Daniels. It has made Indiana more competitive for business and jobs. I have no plans to cut veterans’ benefit and this change, if implemented, will help provide the best benefits we can provide to our veterans – a robust economy and a steady job.”

In contrast, Representative Pillich voted for $2.1 billion in increased taxes and fees contained in H.B. 1 and H.B. 318. “I’m sure the Democrats would love to talk about anything but the increased taxes they voted for and the 400,000 jobs that have left Ohio since 2006,” said Wilson.
Wilson’s campaign is chaired by Major Brad Wenstrup, an Iraqi War veteran and former candidate for Cincinnati Mayor. Wilson’s campaign manager, Maggi Cook, is the daughter of a World War II veteran, and lost a brother in Vietnam in 1968. Her son, Sgt. Robert Cook currently serves with the 101st in Afghanistan. His younger half-brother, Sgt. Joe Cook, lost his leg in an IED attack in 2007. “I am honored to have the support of so many veterans. I am proud that they are standing up on my behalf to fight the smears. This is the kind of politics we are working to change,” declared Wilson.

About Sgt. Chris Hammond: Hammond joined the Marine Corps at age 17 and received basic training at Parris Island, South Carolina in 1994. During this grueling test, Chris learned what true honor, integrity, courage, and commitment were and how to serve others more than oneself. Chris graduated basic training with honors as his Series Highest Marksman and subsequently received 4 awards of Rifle Expert.

Chris was also honored to make the rank of Sergeant (E5) in just over 4 years. Throughout his 2 tours overseas in Okinawa, mainland Japan, and South Korea, Chris earned 2 Sea Service Deployment Ribbons with a bronze Star designation, 2 Medals of Good Conduct, 1 National Defense Service Medal, 2 Meritorious Masts and 2 Letters of Commendation and completed 8 years of honorable service.

Chris is the proud father of 2 daughters. His wife Brenda (Larson) Hammond, is a daughter of the American Revolution through the Chenoweth family bloodline in southern Ohio during the Indian raids and massacre along the Ohio River Valley in 1789. Chris and his family reside in Blue Ash, OH.
